  1. Acceptance of Terms

By accessing this website or purchasing any product from Iron Health Peptides (“Company,” “we,” or “us”), you agree to be legally bound by these Terms and Conditions (the “Terms”). If you do not agree, you must not use this website or purchase any products.

  1. Research Use Only – No Human or Animal Use

All products sold by the Company are sold strictly and exclusively for laboratory, analytical, or scientific research purposes only.

UNDER NO CIRCUMSTANCES ARE ANY PRODUCTS INTENDED FOR OR AUTHORIZED FOR HUMAN CONSUMPTION, VETERINARY USE, DIAGNOSTIC USE, THERAPEUTIC USE, CLINICAL USE, OR ANY FORM OF INGESTION OR ADMINISTRATION TO HUMANS OR ANIMALS.

By placing an order, you represent, warrant, and certify that:

  • You are purchasing solely for legitimate research purposes;
  • You will not use, resell, distribute, or permit use of any product in violation of this Section;
  • You understand and accept the experimental nature of the products.
  1. No Regulatory Approval

You acknowledge and agree that the products and information on this website have not been evaluated, approved, or authorized by Health Canada, the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other regulatory authority.

No claims are made regarding safety, efficacy, or suitability for any regulated use.

  1. Disclaimer of Representations and Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

THE COMPANY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:

  • IMPLIED WARRANTIES OF MERCHANTABILITY;
  • IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE;
  • WARRANTIES OF NON-INFRINGEMENT;
  • WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY THE COMPANY SHALL CREATE ANY WARRANTY OR REPRESENTATION.

  1. No Reliance

You acknowledge and agree that:

  • You have not relied on any statement, representation, or omission except as expressly stated in these Terms; and
  • You are solely responsible for determining the appropriateness of any product for your intended research use.
  1. Assumption of Risk

You acknowledge that peptides and research chemicals are experimental and inherently hazardous.

You voluntarily assume all risks, known or unknown, foreseeable or unforeseeable, arising from the purchase, handling, storage, use, misuse, or disposal of any product.

  1. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, DATA, BUSINESS, OR BUSINESS INTERRUPTION;
  • PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE;
  • ANY THIRD-PARTY CLAIMS.

TOTAL LIABILITY CAP:

If liability cannot be excluded, the Company’s aggregate liability shall not exceed the amount paid by you for the specific product giving rise to the claim.

  1. Waiver and Release

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE THE COMPANY AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SHAREHOLDERS, SUCCESSORS, AND ASSIGNS (THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, CAUSES OF ACTION, OR LIABILITIES. YOU FURTHER AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, LOSSES, OR EXPENSES (INCLUDING REASONABLE LEGAL FEES) ARISING FROM YOUR USE OF THE PRODUCTS.

  1. Indemnification

You agree to indemnify, defend, and hold harmless the Company from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of any product;
  • Your breach of these Terms;
  • Your violation of any law or regulation;
  • Any third-party claim arising from your conduct.

This indemnification obligation specifically includes, without limitation, any and all costs, legal fees, and administrative fines incurred by the Company resulting from any government investigation, regulatory action, or seizure arising out of your diversion of products for unauthorized use, resale, or any violation of applicable local or international laws.

         10. Age and Legal Capacity

    You represent and warrant that you are at least 18 years of age and legally capable of entering into binding agreements.

         11. Orders, Shipping, and Risk of Loss

    All sales are final. Title and risk of loss pass to you upon shipment. The Company is not responsible for delays, seizures, or losses caused by carriers or customs authorities.

         12. Governing Law and Venue

    Except where arbitration applies, these Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You attorn to the exclusive jurisdiction of Ontario courts.

        13. Severability and Entire Agreement

    If any provision is held unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and the Company.

       14. Reservation of Rights.

    The Company reserves the right, in its sole and absolute discretion, to refuse sale, cancel any order, or terminate website access to any individual or entity at any time and for any reason. This includes, but is not limited to, instances where the Company suspects a buyer intends to use products for human or animal consumption or any other unauthorized purpose in violation of these Terms.
